Do you require a special needs trust?

Determining what is going to happen to your family after you pass on can be a difficult thought, one that may be even more complicated if you have a child who will likely require lifelong assistance. If you are unsure about whether or not you will require a special needs trust, there are a few things you need to know. We at the Law Offices of Alice A. According to the California Department of Health Care Services, there are different types of special needs trusts for which your loved one can qualify.  Some are designed for younger people who are under the age of 65, while others can be used for disabled individuals of any age. If you plan to create a trust for someone aged 66 or over, be aware that the account will need to be managed by a non-profit organization.

 

There are several benefits you gain when you create a special needs trust. One is that the assets you bequeath that person will not affect his or her eligibility for public assistance benefits. If you do not create this trust and leave an inheritance to your loved one, he or she may no longer be able to qualify for this support.
